Freehold vs leasehold property in Delhi: what is the difference?

Freehold means you own the land and the building outright. Leasehold means the land belongs to a lessor, usually the DDA or the L&DO in Delhi, and you hold it on lease. Many leasehold properties can be converted to freehold. Before you buy, check 1 thing first: what the title documents say.

What is the difference?

On a freehold property you own the land and the building with no lessor above you. On a leasehold property you hold the right to use the land on the terms of a lease, and the lessor keeps the underlying ownership.

The difference shows up when you transfer the property, borrow against it or rebuild it, because the lease may impose conditions or need the lessor's permission.

How do you check whether a property is freehold?

Read the sale deed and the chain of earlier deeds. A freehold deed says the property is freehold or shows a conversion deed from the lessor. A lease deed, a lessor's name or a clause needing the lessor's consent to transfer points to leasehold.

Ask the seller for the conversion deed if the property was converted, and have your lawyer confirm it with the lessor's records.

How does conversion from leasehold to freehold work?

The lessor, such as the DDA or the L&DO, has run conversion schemes that let an eligible leaseholder pay a charge and sign a conversion deed. Eligibility, the charge and the procedure are set by the lessor and have changed over time.

Do not rely on an article or a seller's word for the current terms. Ask the lessor, and let your lawyer confirm what applies to the exact plot.

Does leasehold affect price and loans?

Freehold property usually sells more easily, because a buyer and a bank need fewer permissions. A leasehold property may need the lessor's no-objection for a sale or a mortgage, which adds time and cost.

Raghav Chopra tells you which kind a property is before you spend time on it, and prices the lease conditions into the offer.

Frequently asked questions

Is a freehold builder floor in South Delhi safer than a leasehold one?

Freehold is simpler because there is no lessor to consult, so transfers and loans run more smoothly. A leasehold property can still be sound if the lease is long and conversion is possible. The safer choice is the one whose documents you have checked, which is why Raghav Chopra reads the deeds first.

Can a leasehold property be converted to freehold?

Often yes, under the lessor's conversion scheme, on payment of a charge and signing a conversion deed. Terms and eligibility are set by the lessor and have changed over time, so ask the DDA, the L&DO or the relevant body for the current position before you rely on it.

Who pays the conversion charge, the buyer or the seller?

It is negotiable and should be settled in the agreement to sell. Some sellers convert before selling, others reduce the price and leave it to the buyer. Get the conversion cost quoted by the lessor before you agree, so the price reflects it.

Does leasehold property get a home loan?

Banks do lend against leasehold property, but they usually ask for the lease deed, the lessor's permission to mortgage and sometimes a clear conversion path. Expect more paperwork than for freehold. Ask your bank for its checklist early, before you pay a token.
