Mutation of property in Delhi: what it is and how to do it

Mutation records the new owner's name in the municipal tax records after a purchase. In most of South Delhi that is the MCD. It is the 2nd step after registration, not a transfer of title, but banks and later buyers ask for it, so a buyer should not skip it.

What is mutation and why does it matter?

Registration transfers ownership. Mutation is separate: it changes the name against the property in the local body's records, so property tax bills come to you and the body knows who owns the building.

Courts have held that a mutation entry does not by itself prove ownership. It still matters in practice, because a bank, a later buyer or the municipal body will ask for it before they treat you as the owner.

Which body does the mutation?

In most of South Delhi the Municipal Corporation of Delhi (MCD) mutates the property. In the New Delhi Municipal Council area and in cantonment areas, the NDMC or the Cantonment Board does it, and for leasehold property the lessor, such as the DDA or the L&DO, keeps its own record.

Raghav Chopra checks which body applies before the sale deed is signed, so you know whom to approach.

Which documents are needed?

The list is set by the body and changes, so check its website before you apply. The usual set is the registered sale deed, proof of your identity and address, the latest property tax receipt and the seller's mutation or ownership record.

Your lawyer prepares any affidavit or indemnity the body asks for. The table shows where each document comes from.

How do you apply, and how long does it take?

Most bodies now take applications online and may call for an inspection or a hearing. The body publishes its own service timelines and fees, and both change, so use its current notice rather than a figure from an article.

Apply as soon as the sale deed is registered. Delay makes the previous owner's name stay on the tax record, and the paperwork gets harder to assemble as time passes.

What happens if mutation is not done?

The sale stays valid, but property tax notices keep going to the previous owner, the building's records show the wrong name and the next buyer or bank will ask you to fix it first.

On a Rs 10 Cr floor, that is a delay you do not want at resale. Treat mutation as part of the purchase, not an afterthought.

Frequently asked questions

Is mutation mandatory?

Mutation is not required for the sale deed to be valid, but the municipal body expects it, and banks, later buyers and tax records depend on it. Treat it as mandatory in practice. Apply soon after registration so the property tax record shows your name.

Can I sell a property without mutation?

Legally the owner under a registered deed can sell, but a buyer's lawyer and bank will ask for the mutation record and may delay or refuse the deal without it. Doing the mutation first removes that objection and usually speeds up the sale.

Does mutation prove ownership?

No. Courts have held that a mutation entry is for tax and record purposes and does not confer title. Ownership rests on the registered sale deed and the chain of earlier deeds behind it, which is why Raghav Chopra checks the title chain separately from the mutation record.

How is mutation done after inheritance?

The heirs apply with the owner's death certificate, the will or a legal heir certificate, and no-objection statements from other heirs where needed. Your lawyer prepares these. If the family disagrees, the body may ask for a court order, so settle the succession first.
